Guidance on Pre-Settled Status Applications for Babies Born in the UK to EU Parents

When a Child Is Automatically British at Birth

A child born in the United Kingdom is considered British at birth only if at least one parent, at the time of birth:

Is already a British citizen, or
Holds Indefinite Leave to Remain or Settled Status under the EU Settlement Scheme (EUSS).

If neither parent meets these conditions – for example, both parents only hold Pre-Settled Status – the child will not automatically be British, even if born on UK soil.

Securing Your Child’s Status – Apply to the EU Settlement Scheme (EUSS)

If your child is not automatically British, they will need their own EUSS application to secure lawful residence in the UK.

This status is important because it allows the child to:

Live lawfully in the UK
Access NHS healthcare without risk of charges
Enrol in school
Access benefits (where eligible)
Travel in and out of the UK
Exercise future rights to work or study

Failing to apply means the child may not have a recognised immigration status, which may result in administrative, legal and financial difficulties later in life.

Deadline to Apply

Parents are expected to submit the EUSS application within 90 days of birth.
If this deadline has passed, it may still be possible to apply, but a late application will require written evidence and an explanation of the delay.

What if the Passport Is Not Yet Available?

If the child’s foreign passport (for example, Italian passport) is delayed, it is still possible to make an application using:

The child’s birth certificate, and
A paper EUSS form

Once the passport is available, the details can be communicated to the Home Office to update the file. It is advisable to request the passport from your consulate as early as possible to avoid complications.
