If you are married to someone living in the UK and wish to join them to build your life together, the UK Spouse (Family) Visa may be the right option. This visa allows a husband, wife or civil partner to come to the UK, live as a family, and work or study once they arrive.
At Baraka Legal, we assist eligible couples by preparing clear, well-organised applications — so the process feels easier and less overwhelming.
Who Can Apply
To apply for a Spouse Visa, all of the following must apply:
- You are legally married or in a civil partnership recognised in the UK
- Both partners are aged 18 or over
- You intend to live together permanently in the UK
- Your partner in the UK has legal residence — for example:
- British citizenship
- Indefinite Leave to Remain (ILR)
- Settled Status under the EU Settlement Scheme
- Pre-Settled Status in their own right
- You meet the financial, accommodation and English language rules
Main Requirements
1️⃣ Genuine Relationship
You must show that your relationship is real and continuing — through documents such as a marriage certificate, messages, photos, travel tickets, joint bills or other supporting evidence.
2️⃣ English Language
The applicant must normally meet the English language requirement (A1 level test), unless exempt.
3️⃣ Accommodation
You must demonstrate you have somewhere suitable to live as a couple in the UK, which is not overcrowded.
Financial Requirement
To be eligible for a Spouse Visa, the Home Office requires a minimum level of income.
Normally, the UK-based sponsor must earn £29,000 per year.
Using Savings Instead of Income
If you do not meet the £29,000 income threshold, you may still qualify using cash savings instead of earnings.
To qualify through savings alone, you must show £88,500 held for at least 6 consecutive months
Savings can be held:
- by you
- by your partner
- or jointly
You will need to provide full bank statements, evidence of where the money came from, and confirmation that the funds are accessible.
If you are unsure whether you qualify, it may be useful to review the Government guidance before requesting support.
👉 If this is your situation, please contact us — we will be happy to assist.
How Long Does the Visa Last?
A Spouse Visa granted from outside the UK normally lasts 2 years and 9 months.
Before it expires, you must apply to extend it.
After 5 years on the spouse route, you may be eligible for:
- Indefinite Leave to Remain (ILR)
- and later, British citizenship (if desired)
